Affiliate Terms and Conditions

This Affiliate Agreement (the “Agreement”) is entered into between BuyWog.com (“Company,” “we,” “us,” or “our”) and the individual or entity registering for the affiliate program (“Affiliate,” “you,” or “your”).
By submitting an application or by using our affiliate links, you agree to be bound by these Terms and Conditions.
1. Overview
The Company operates an e-commerce website selling [Insert Product Types, e.g., electronics, apparel, home goods] (the “Products”). This Agreement sets forth the terms and conditions under which the Affiliate may promote the Products and earn commissions on qualifying sales.
2. Enrollment
To enroll in the Affiliate Program, you must submit a complete application via our website. We reserve the right to accept or reject any application in our sole discretion. We may reject applications from sites that are:
Engaging in illegal activities or promoting violence.
Containing sexually explicit content.
Promoting discrimination based on race, gender, religion, or nationality.
Infringing upon intellectual property rights.
3. Affiliate Responsibilities
3.1. Acceptable Promotion: You agree to promote the Products in a lawful and ethical manner. You are solely responsible for all content on your website or platform.
3.2. Prohibited Activities: You are strictly prohibited from:
Spam: Sending unsolicited commercial emails (spam) in violation of the CAN-SPAM Act or any other applicable law.
Paid Search/PPC: Bidding on keywords or phrases containing “BuyWog,” “buywog.com,” or any misspellings or variations thereof on search engines (e.g., Google, Bing) without our prior written consent.
Trademark Infringement: Registering domain names that are identical or confusingly similar to “BuyWog” or our product names.
Coupon/Deal Abuse: Posting our coupons or deals unless specifically authorized in writing. You may not use your own affiliate link to make personal purchases or attempt to “cookie stuff” (fraudulently overwriting other affiliates’ cookies).
Price Scraping: Using automated tools to scrape our pricing or product data to undercut or misrepresent us.
3.3. FTC Compliance: You agree to comply with the Federal Trade Commission (FTC) Endorsement Guidelines. This requires you to clearly and conspicuously disclose your material relationship with us (that you earn a commission) on any page where you use affiliate links. A simple statement like “This post contains affiliate links” placed near the links is required.
4. Commissions and Payouts
4.1. Commission Structure: Affiliates earn a commission of [Insert Percentage, e.g., 10%] of the net sale price (excluding taxes, shipping, refunds, and chargebacks) for each Qualifying Purchase.
4.2. Qualifying Purchase: A “Qualifying Purchase” occurs when a customer clicks your unique affiliate link and completes a purchase within the cookie duration (see Section 5). Purchases made via fraudulent methods, including fake credit cards or self-referrals, will not qualify.
4.3. Payment Schedule: Commissions are paid on a [Net 30 / Net 60 / Monthly] basis. You must have a minimum accrued commission balance of $[50.00] to receive a payout. Payments are made via [PayPal / Bank Transfer / Check] .
4.4. Refunds and Chargebacks: If a sale that generated a commission is refunded to the customer, or if a chargeback occurs, the corresponding commission will be deducted from your future earnings. If a commission has already been paid, the amount will be invoiced to you and deducted from future payments.
5. Tracking and Cookies
We use a third-party affiliate tracking system. A cookie will be placed on the customer’s browser when they click your affiliate link. The cookie duration is [Insert Duration, e.g., 30 days] . If the customer does not purchase immediately but returns within the cookie period and purchases, you will receive the commission. We are not responsible for browser settings, ad-blocking software, or other technical issues that prevent accurate tracking.
6. Intellectual Property
6.1. License: We grant you a non-exclusive, non-transferable, revocable license to use our logos, banners, and product images (the “Licensed Materials”) solely for the purpose of promoting the Products under this Agreement.
6.2. Restrictions: You may not alter the Licensed Materials in any way that misrepresents the Company or its Products. All goodwill arising from the use of the Licensed Materials shall inure solely to the benefit of the Company.
7. Relationship of Parties
You are an independent contractor. Nothing in this Agreement shall create any partnership, joint venture, employment, or agency relationship. You have no authority to bind the Company to any contract or obligation.
8. Term and Termination
8.1. Term: This Agreement begins upon the acceptance of your Affiliate application and continues until terminated.
8.2. Termination for Cause: We may terminate this Agreement immediately, without prior notice, if you violate any provision of this Agreement, including engaging in prohibited marketing activities.
8.3. Effect of Termination: Upon termination, your license to use the Licensed Materials ceases, and you must remove all affiliate links and references to BuyWog.com from your website within 24 hours. Accrued, unpaid commissions earned prior to the date of termination (excluding commissions generated by improper means) will be paid out according to the standard payment schedule.
9. Modification
We reserve the right to modify any of the terms and conditions contained in this Agreement at any time. We will notify you of changes by posting the new terms on the affiliate dashboard or via email. Your continued participation in the program following such modification constitutes your acceptance of the changes.
10. Limitation of Liability
The Company will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement, even if we have been advised of the possibility of such damages. Our aggregate liability arising under this Agreement shall not exceed the total commissions paid or payable to you in the six months prior to the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless BuyWog.com, its officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your breach of this Agreement or your activities in promoting the Products.
12. Governing Law
This Agreement shall be governed by the laws of India , without regard to its conflict of laws principles.
